Field of Application

These terms and conditions (T&Cs) are valid for all Nalusurf offers, registered holder Ralf Geerdts. This remains valid for all mutual claims arising from and in connection with a signed agreement concluded between the customer (Participant of a wave riding-course, or renter of a camera board and/or surfboard) and Nalusurf. T&Cs in their entirety are valid upon signature of the corresponding contract.

Participation conditions
Anyone may participate upon acceptance of the terms and conditions and restriction of liability in writing. Participants under 18 years require the signature of the legal representative. Participants must possess a strong ability to swim and appropriate athletic ability. The participant declares expressly that there are no existing medical conditions that would adversely impact the undertaking of surfing or any other (athletic) activities which he/she participates in. All sporting activities occur at the participant's own risk.

Registration
Registration can be written (e.g. by e-mail) or verbal (e.g. telephone). Registration is obligatory for the participant upon e-mail-entry at Nalusurf. In the case of telephone registration the obligation occurs for both parties upon conclusion of the conversation. For participants under 18 years of age the approval and signature of the legal representative is required.

Payment
Unless agreed in writing by the contracting parties, payment must be made in cash no later than then last day of the course or in the case of camera and/or surfboard rental payment is due upon the return of the rental. EUR 200.00 in cash as well as a valid piece of identification (passport, identity card) is required as deposit for the rental of the camera board. Payment is due latest at the return of the camera board rental. For surfboards rentals, a valid piece of identification (passport, identity card) is required and will be held for deposit. Payment is due latest at the return of the surfboard rental.

Services
Prices for Nalusurf's rentals and courses are indicated on its brochures and/or homepage. Nalusurf will not assume parental supervision duties for minor participants.

Surfing Course
Nalusurf reserves the right to change the course (lesson topics etc) as needed and will endeavor to keep all changes to a minimum so as not to adversely impact the overall surf course in question.

"Free Shuttle Service"
Nalusurf does not guarantee the "Free Shuttle Service". Nalusurf is exempt from any demands of recourse or claims of compensation. This applies also to all costs resulting from taxis, buses etc. Participants will be informed of any changes to the shuttle service immediately after they occur.

CANCELLATION OR EARLY TERMINATION OF THE COURSE BY THE PARTICIPANT
Cancellations of surfing courses, camera board and/or surfboard rentals is always possible and must be made in writing by email. The cancellation is effective as per the day it is received by Nalusurf.

Participants may terminate surfing courses due to an injury or for private reasons; however, it is left to Nalusurf's discretion whether the course may be made up or whether a partial refund of the course fee will be given. Participants are not entitled to any further claim or recourse in regard to compensation which also applies but is not limited to costs arising from taxis etc.

CANCELLATION OR EARLY TERMINATION OF THE COURSE BY NALUSURF
a) Cancellation of the contract may occur due to extraordinary circumstances.
If the surfing course through force majeure, world events, or other unforeseeable circumstances/dangers impacts the ability to carry out the course, Nalusurf reserves the right to cancel some or the entire course in question. It is left to Nalusurf's discretion as to whether the course in question will be made up or whether full or partial restitution of the course fees will be made. Participants are not entitled to any further claim or recourse in regard to compensation which also applies but is not limited to costs arising from taxis etc. Nalusurf agrees to notify the participant as soon as any changes to the surfing course are known.

b) Cancellation of the contract due to accident or illness In the case of accident, illness etc., of the surf instructors, Nalusurf will make an effort to provide a substitute instructor. If this should not be possible by way of exception, a surfing course may be cancelled. It is up to Nalusurf's discretion as to whether the course in question is made up for or whether restitution of the received payment in respect to the course occurs. Participants are not entitled to any further claim or recourse in regard to compensation, which also applies but is not limited to costs arising from taxis etc. Nalusurf agrees to notify the participant as soon as any changes to the surfing course are known.

c) Course exclusion

Participants agree to follow all instructions given by the surf instructors. If the participant does not follow the instructions during the course in spite of a warning given on the part of the surf instructor, or should the participant present a danger to themselves or others, Nalusurf reserves the right to exclude the participant from the surfing-course. The participation fee will not be refunded. The possession and the consumption of alcohol or the possession/use of illegal drugs before and during the course is strictly forbidden. Nalusurf reserves the right to exclude the participant from the surfing-course. The participation fee will not be refunded.

LIABILITY
Nalusurf is responsible within the framework of the care of duty for conscientious and correct preparation/carrying out of the surfing-courses, careful selection and supervision of their partners and employees, adherence to delivery specifications and proper provision of the agreed upon contract. Nalusurf is not liable for any unfortunate circumstances including but not limited to possible traffic hindrances which delays or causes postponements of the surfing course and is therefore not liable for any resulting follow-up costs that could arise for the participant. Participation in surfing-courses, offered (athletic) activities, associated travels, and any of the other Nalusurf offers such as camera board and surfboard rentals are done at the participants own risk. Nalusurf is not liable for any potential dangers arising in connection with its courses and/or rentals and the participant willingly assumes responsibility for all potential dangers that might arise. Participants are liable for all damages to rentals and Nalusurf reserves the right to apply the EUR 200.00 deposit towards all or part of the costs. A liability for loss and harm of the property of the participants (clothing brought along, articles of value, money etc.) on the part of Nalusurf is not possible. This applies also to any parked vehicles and their contents. Material damages are repaired at the expense of the causer and/or his legal representative. Wet suit and all sports equipment which are the property of Nalusurf are to be handled properly and according to instruction by the participant/creditor and are to be returned on time, and intact. Participants/Creditors are liable damage/loss due to negligence and this liability extends to any damage caused by a third party. The camera board company will retain the associated deposit for its camera until the participant/creditor has replaced the damage item in question to the current market value that is defined by Nalusurf and/or pays all associated repair costs.

INSURANCE
Participants are responsible for all associated insurance coverage. Personal accident insurance is not contained in the price. It is recommended that participants carry insurance that covers accidents incurred abroad (international insurance coverage).

CHANGES OF THE EVENT COURSE
Nalusurf reserves the right to make changes to any of it single courses provided that these changes became necessary after the conclusion of the contract conclusion and the changes in question do not influence the history of the course considerably. This includes any changes to event courses. In particular changes may occur due to weather conditions whereby theoretical topics may be covered in lieu of physical practice. Participants do not have any claim to restitution of the course price and/or associated installments.

GUARANTEE
Nalusurf will endeavor to fulfill the contract to its fullest and/or provide a suitable alternative and participants/legal signatories will agree by signing the T&Cs to allow a reasonable amount of time before seeking an alternative solution. Should the participant/legal signatory wish to have an alternative solution than that proposed by Nalusurf, the proposal must be carried out on site and in writing. Nalusurf can refuse the remedy if it requires a disproportionate expenditure. Participants/legal signatory agree to make every effort to ensure that the courses run smoothly and Nalusurf will not be held liable for any issues arising from inappropriate participant behavior. The participant is, in particular, obliged to submit his complaint to Nalusurf immediately on site and in writing. Nalusurf is obligated to guarantee a solution provided that this is possible.

EXCLUSION OF CLAIMS/LIMITATION
All claims against Nalusurf in regard to equipment, injuries etc., must be submitted no later than one month after the conclusion of the contract. Nalusurf will not be liable for any claims asserted after this one month period unless the claims could not be submitted due to no fault of the participant. Participant's claims expire within one of the concluded contract.

USAGE OF PICTURES AND DATA/DATA PROTECTION
Participants agree to allow themselves to be photographed during the surfing-course at events and sporting activities and agrees that Nalusurf may use these photographs for marketing purposes. This consent may be revoked at any time provided the request is made in writing. Participants agree that data in regard to their person (Inventory data) may be used for market analysis and marketing purposes. In regard to the registered data of the participants, Nalusurf commits itself to adhere to the data protection and media-legal regulations, with particular regard to ensuring that data are handled confidentially. This consent may be revoked by the participant at any time in writing.

FORGOTTEN PROPERTY
Objects left behind are sent on to participants upon request and at their cost/risk. The storage time is 6 months.

INEFFECTIVENESS OF SINGLE REGULATIONS
Should certain conditions of these terms and conditions no longer be valid, they shall be disregarded; however the other valid conditions remain in force and unchanged. The ineffectiveness of a single regulation of the contract or the terms and conditions does not imply the ineffectiveness of the entire contract.

VENUE
Any claims against Nalusurf must be carried out at Nalusurf's location and its appropriate jurisdiction.
